There appear to be positive developments in the tortured progress  of the data protection regulation in Brussels. The UK Direct Marketing Association reports that the Irish government has tabled a draft of the first four chapters of the regulation which will make the regulation much more sensitive to legitimate business concerns. There are five key changes being proposed: the right to data protection is not absolute; direct marketing is legally recognized as a legitimate interest in processing data;consent now would be “unambiguous” not “explicit”; each member state will determine if a data protection officer must be appointed in every company; not every security breach will have to be notified.

 

Some 3000 amendments to this massive piece of legislation have been proposed and these are still under study by the relevant committee.
